Terms and conditions for membership
This is a true translation of a similar document in Chinese. If there is any discrepancy in meaning between the two, the Chinese version will dictate and take precedence.
1. Acceptance of the Terms and Conditions (T/C)
A warm welcome to all on-line members who have registered with BALLOON ART WORKSHOP Ltd (henceforth called BAW)) for our service. Stipulated below are our terms and conditions (T/C)which we apply to regulate our services to you as members. Please be noted that we reserve the right to revise the service terms as we see fit and we suggest that each time you use this service, you should read this T/C.
Whenever you use this service which is provided by us at no cost to you, you have implicitly agreed to these terms and conditions stipulated here. Each of us should be obligated to these T/C and we will attempt the best to post in public any revision of our direction or provision in our services. In future, these T/C, if needed to be revised in either direction or provision, will be posted for reference for consideration to use our services. If you do not agree with any items posted here, please do not use this service.
Revision on terms and conditions
BAW HK Ltd reserves the right to unilaterally make the decision to change either temporarily, now and then, or for a long time any contents in this website as it sees fit. When BAW needs to make such changes, it will suspend or terminate its website services without advance notification and will take no responsibility, financial or otherwise, to the user or the third party for any harm because of our unilateral decision.
2. Duties of Registered Members
i) In order to facilitate this service, the user agrees with the following items:
1. You shall provide to us true and correct personal information as required in the registration form “(hereafter refers to as "registration material");
2. You shall update and revise any data in the registration material whenever there is a change in status. If you provide any mistake, incorrect, incomplete or misleading material in the registration, or BAW has a reasonable suspicion that the registration material is not trustworthy, BAW is authorized to suspend or terminate your account and reject any future request for services, either in part or whole.
ii). In order to use certain services, you are required to provide confidential personal information such as mobile telephone numbers, the Hong Kong ID card or the commercial registration number. For information on any user name, account number, password for security reasons, you have the responsibility to safeguard this information and not disclose them to others. You specially agree that if there is a breach on the security of this information and as a result, there is loss or harm to you or a third party, BAW will not bear any responsibility for it (whether or not you knew in advance the breach of security).
iii) Member’s Behavior
You are advised that regardless in public or in private, you should take full responsibility to the ownership of the related content of all information, data, text, software, music, sound, pictures, designs, images, communication media or any other materials (below referred to as "the content" ) communicated by them. Additionally for any services or contents publicized through this website, BAW does not monitor or guarantee their accuracy, the integrity or the quality. You must clearly understand that, when using the website, you may come across unpleasant, indecent or the harmful content. Regardless of any situation, BAW will not bear any responsibility as a result of mistakes or deceit caused by any services or contents publicized by others, either by email or other means of transmission via this website. You specially agree not to use this website to carry out or populate the following mis-conducts:

Upload of any the announcement, posts or other ways to transmit any illegal, threat, harassment, slander, vulgar, obscene, or stabs, that interfere with other people privacy, or any contents that can induce racism, nationalism or other harmful behavior;

Upload of any announcement, posts or other ways to transmit contents that violate the third party patent, the trademark rights, the business secret, the copyright or other property rights ﹝"the right" that do not belong to the user. Or

Upload of any announcement, posts or other ways to transmit any content software or design features that contain virus with intention to cause harm, hinder operation or destruction to others in areas of computer software, hardware, or the telecommunication equipment, computer code, the file or the procedure material. BAW is authorized to obliterate any content that it sees there is a threat to its computer security without any need to inform you, the user. You further agree that under relevant law stipulation and lawful request, when BAW sincerely believes it has the reason to do so, will disclose the related content in order to enable BAW to
(1) observe the legal rule and the procedure;
(2) carry out this service Terms and Conditions;
(3) respond in self-defense to third party's infringement law; or
(4) protect the right and the property of any individual or BAW, its user and the public.
You agree and understand that all technical content and any service transmission that is processed in this website may be carried forward to other networks, and may get revised in order to comply with certain equipment technical demand.
3. Declaration of our duties

Product Display

BAW will not be able to take any responsibility for this discrepancy in colors.

Other than all disclosure stated herein, BAW will not be held responsible or legally liable for any harms, damages, losses, accidents, negligence, contract destructions, slanders, copyright or intellectual property right infringements (including infections because of the computer virus) that are results of your on-line registration. All contents in this service do not reflect opinion of the BAW.
6. Responsibility Limitations
You agree and understand that based on reasons below, BAW does not undertake any direct, indirect, supplementary, or the punitive compensation (even if BAW has been informed of the situation does not constitute an agreement of possibility of the compensation) for losses, including but is not restricted in the profit, goodwill, uses, material losses or other invisible losses:

via this service, any service purchase or any commodity, material, data, information or the service, exchanged for any substitution and service,

The data collected such as applicant name, the ID card number, the telephone, the email address etc are used for registration only. Balloonart.com.hk registration member's account material and the personal record file have the password protection. Only you the user have the right and are able to read or edit the individual material. We suggest that each time after you are done with the work, please log-off the account and close the windows browser. Thus, you can share the computer facility with others with confidence, either in the library, the internet bar and any public places.
